Lex Counsel, is a Costa Rican-based law firm founded in 2002 by attorneys, formerly members of traditional attorney firms of Costa Rica, who decided to merge their efforts to provide counsel with a new vision in Domestic and International Business Practice, including Civil, Corporate, Foreign Investment, Finance and Banking Law, Energy, Construction, Agency, Real Estate and Trust Law, Litigation and Arbitration, Insurance, Patent and Trademark Law. Its founders are recognized as leading attorneys within the community. Additionally, they have been instrumental in drafting, passing through Congress and implementing some of the most important statutes and regulations in their respective areas of practice, such as the Free Zone Laws and regulations, systems for assembly for export etc. Its members have been also heavily involved in non-governmental institutions key for investment and international trade as well as negotiations at Governmental levels in those same areas. A recent addition to the expertise of the firm is its strong involvement in infrastructure projects (the financing of the Costa Rican main Airport, the development/administration of Costa Rica’s Pacific main ports, etc.). It has been a leader in the implementation of alternatives for improving credit and finance documentation, successfully implemented in some of the most important tourism related projects (Marriott, Radisson and Four Seasons developments). This improvement has been strongly supported by Lex Counsel’s Trust Law practice division. The firm’s expertise in litigation/arbitration, includes landmark cases, such as the main expropriation case in the history of Costa Rica, the Santa Elena Case. A client’s property of 50,000 acres, 13 beaches and 30 miles of beachfront which the Government converted into a National Park. This case was finally solved in arbitration at the World Bank’s sponsored ICSID, in Washington, D.C. with a major involvement of key members of our Firm. Among the firm’s members and staff, experience is not limited to the practice of law, but it extends to the Academy (professors of law) and Public Service (consultants to the higher levels of Government).
